Welcome to Trendy Tees! These Terms and Conditions outline the rules and regulations for the use of the Trendy Tees website, located at www.trendytees.co.nz (the "Site").

By accessing this website and purchasing our custom apparel, we assume you accept these terms and conditions in full. Do not continue to use Trendy Tees if you do not agree to all the terms and conditions stated on this page.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks via our secure payment gateways.

2. Custom Designs and Copyright

When you use our online designer or upload artwork to be printed via heat transfer vinyl (HTV):

  • You Must Own the Rights: You guarantee that you hold the necessary rights, licences, and permissions to use any logos, text, or artwork you submit. You agree to indemnify and hold Trendy Tees harmless against any legal claims regarding copyright or trademark infringement arising from the designs you supply.

  • Content Restrictions: We reserve the right to refuse to print any material that we deem offensive, inappropriate, or discriminatory or that clearly violates intellectual property laws. If an order is cancelled for this reason, a full refund will be issued.

3. Products, Textures, and Colors

We have made every effort to display as accurately as possible the colours and textures of our apparel and speciality vinyls (such as puff, glitter, and metallic finishes).

  • Variations: Because every device screen displays colour differently, we cannot guarantee that your computer monitor's display of any colour will be 100% accurate. Furthermore, due to the physical nature of speciality HTV, slight variations in texture or placement may occur during the manual heat-press process.

  • Availability: All descriptions of products or product pricing are subject to change at any time without notice. We reserve the right to discontinue any product or garment style at any time.

4. Pricing and Payment

All prices on our site are displayed in New Zealand Dollars (NZD) and include GST unless otherwise stated. We reserve the right to change our prices at any time. The price charged for an order will be the price in effect at the time the order is placed.

5. Accuracy of Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, or distributors.

6. Third-Party Links and Tools

We may provide you with access to third-party tools (such as our website hosting platform, Wix, or integrated design customisers) over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, Trendy Tees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site or our custom products. Our liability is strictly limited to the purchase price of the specific item in question.

8. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New Zealand, specifically including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
